In most cases, flag desecration is considered only a misdemeanor. Yet, in a state like Illinois, flag desecration is a felony. Wisconsin used to make it a felony, but the entire provision on flag desecration was struck down in 1998.
Georgia, Louisiana, Mississippi, and South Carolina have all protected Confederate flags on an equal basis with American and state flags. Thus, burning a Confederate flag is the same crime as burning an American flag.
It's one of those state things where they will still arrest you, but if you get a lawyer they drop it immediately. I'm sure people have ended up in prison for it anyways because our legal system is a joke and most people never even get a lawyer/trial.
