I think he'll probably still be tried as an adult. However, at this time, I don't think it's likely that they'll succeed in convicting him of first degree murder. Since there are photos of protesters tackling him and hitting him with a skateboard (DEFINITELY the same as shooting to kill with an AR style rifle), I think they'll buy whatever galaxy-brained self defense arguments he'll make.
